Phoenix Fire: How to make enemies and create adversaries


Tabetha Jones and her cohorts arrived on my blog and created an amusing furor .

I stand by my statement that Phoenix Fire is run like a vanity press. They expect the authors to pay all of the costs up front. The established norm for a traditional publisher is that the publisher assumes all of the costs and gambles that the book will earn out its expenses. I am hoping to eventually be able to afford to pay a token advance to each author so that even if the book does not earn royalties, they at least have something to show for having published with Daverana.

“..,it is a tale told by an idiot, full of sound and fury, signifying nothing” said Shakespeare’s Macbeth.  And such it is for what happened on my blog. So this becomes an article about what not to do.

I raised my daughter by the Socratic method. I turned arguments into questions. The Athenian philosophers confounded the Romans by arguing one side one day and the totally opposite on the other.   When facts are presented to back up statements, they carry weight and can make for a lively and interesting discussion. This is NOT what happened with Tabetha and her cohorts. They came in guns blazing. Their arguments were not backed by facts. For instance, I was told repeatedly to go speak with various unnamed people to support her claim.

Tabetha’s comments, and those of her cohorts, were filled with irrelevant statements and endless insulting non sequitors.  My questions to her were never answered. I got the usual reactions that are more appropriate to the famous “butthurt report form.”

Let’s start with her “60%” royalties. I asked her to tell me how she figured them. Traditionally, the author is given a fixed percentage of cover price. That does not vary unless (in print cases only) the book is remaindered or reduced in some other way. Trouble arises when the author is promised a percentage of the net. The net is what remains after all costs are covered.  Hollywood and the music industry are famous for their creative accounting practices that can reduce the net to almost nothing. The author should not have to wait for their money until the costs are covered. That is not how it works.  The author’s royalties should come off the top.

The publisher does not own the book. The publisher is renting the book. That is basically what a publishing contract is. The author sells the publisher license to publish. There are other forms, but I’m not going into them here (such as book packagers). The publisher assumes all costs. That’s just how it is.

Another old saying, “You catch more flies with a spoon of honey than a barrel of vinegar.” Tabetha needs to have that tattooed to her forehead so that every time she looks in the mirror she is reminded of it.

There is a huge difference between fame and infamy.  Intelligent people will know what I am talking about.

Time and again, an author or publisher or artist gets criticized for what they are doing and the result is that they make a laughing stock of themselves by throwing a fit. That is infamy. No one ever takes them seriously again. At least no one of worth does.  Now, I’ve put my foot in my mouth at times and had my cheeks burn for a week or more over it. But I did not repeat the error.

Tabetha continually repeats her actions expecting to have a different result.

Dog poops on the floor and instead of punishing him directly, you pat him on the head and “ooooh, honey, it’s not nice to poop on the floor. Mommy doesn’t want you to poop on the floor.”  What does the dog do the next day? He poops on the floor.

The very first thing that a publisher, a writer, an artist needs to learn is to separate themselves from their work/company/whatever. A criticism of the work or the practice is not a criticism of the publisher/writer/artist as a person. The work and the actions stand alone and must speak for themselves. That and only that carries weight.

Another old saying (I’m in one of those anecdotal episodes, so bear with me) is “Actions speak louder than words.” So in this case we have two kinds of actions to weigh. First is the fact that she has not denied that the writer pays for everything. That makes her a vanity. There is no getting away from it. Second is that her behavior is childish.

So what is she saying about herself?

What should we take away from her example?

Well, you have to remove your ego from your work. Yes, positive reactions and reviews are wonderful and they fill us up with fruit of validation.

However, they do not teach us anything. What we learn from is the negative. We learn deeper and more extensively from what we failed at. That’s when we pick ourselves up and dust ourselves off and vow never to make that mistake again.

I believe in triangulation.  I don’t know if shortwave guys still do this or not. If anyone knows, please let me know. But anyways, they have hunts. They have one member hide and let out a signal. Then three or more of them try to get a fix on it from different angles and finally the signals cross right and the hiding member is found.

Flaws in writing, actions, and art  often can be revealed if enough negative feedback occurs and you start to see a pattern. I found a serious plot hole in My Sister’s Keeper (Journey of the Sacred King book one) when three readers had basically the same complaint. I was able to narrow it down and fix it. That’s the authorial blindspot, but that is also for another discussion.

What I am illustrating here is that both Lindsay Anne Kendal (Tabetha’s cover artist) and Tabetha herself could learn from the fact that they are getting this many complaints and negative observations here. They could fix the trouble. I have more hope for Lindsay than I do Tabetha.

Next point: I never allow the author to choose the cover.  That is for me and the editors because most authors would shoot themselves in the foot in terms of marketing decisions. They don’t have enough experience or knowledge of what sells to make a good decision. The cover promotes the book.  That is the first thing reader reacts to.

The publisher does not own the cover. Nor does the writer. Now, an artist can sell all rights, at which point the artwork becomes a stock image for the company or individual who bought it. However, normally the work is rented. The publisher acquires only certain rights and not complete ownership. These are spelled out in the artist’s contract. I mention this because Tabetha thought that having the author pay for the cover, which Tabetha commissions, is really quite novel and wonderful. Well, what do the authors then expect to do with the cover if they leave Tabetha’s company for another one? The new company is not going to want their edition (which might have been given a brand new edit and revision) to have the same cover the previous edition did. That’s just not done.

Well, you can’t eat a cover.

“If the authors wants that as their cover that is up to them. It must have meaning to them.”

Let’s address it from a marketing stand point.

Authors want their books to sell. This is not entirely a point of vanity. If a publisher allows the author to have a cover and title that fails to catch the interest or, even worse, offend a reader or confuse one, then the book will not sell and in the end a disservice has been done to the author. It is a good publisher’s responsibility to prevent an author from shooting themselves in the foot.

Another good thing NOT to do is to add super glue to your foot once it is in your mouth.

Sometimes you have to swallow back the ugly comments you wish to make and suffer in silence. Or fix the situation after admitting you were wrong. It takes a big person to be able to sincerely admit they were wrong.  That makes people like Tabetha about the size of Thumbelina.  Please, if you hope to have a successful career or hobby, leave the super glue in the cabinet and your foot in your shoe.

    I have been researching Tabetha more deeply as people have provided me with leads. One thing I notice is that the “voice” and writing style of her defenders is identical. How many alts is she fielding?

    are very light on facts and details. They seem to all deal with temper and vagueness.

    Pale excuses and adolescent temper tantrums are, I fear, her stock in trade. When those don’t work for her, the alternyms come out to play – all of whom are friends dropping by her house to show their support and hopping on her computer to defend her against the horrible cruelty of those that accuse such a poor, innocent soul as she. How dare they!
    One thing I do find remarkable about Tabetha is her tenacity. Even though she’s been exposed time and time again, she doggedly persists, expecting her untruths and temper fits to get her out of it. Either she really believes her rubbish, which would be pathetic indeed, or she really thinks she’s untouchable. Either way, one thing is certain: She’s amusing to watch.

    I’ve read a lot about this lately and to be honest I’m disgusted by people like this. Sadly I’m seeing it more and more. Fly by night publishers taking money from people and delivering nothing. It not only gives legitimate small publishing houses bad reputations, since everyone seems to wonder if they should be avoided, but it also ruins unpublished authors dreams. I don’t know how people like this sleep at night. I’ve been following this Tabetha Jones and her “crazy rants” on blogs for the last couple of weeks. I think it’s pathetic how much she feels the need to blame everyone but herself for what has happened. I only hope those who read this avoid the new Phoenix Press.
    The only thing I don’t agree with is how the cover artist has been slammed. She is being upset and tainted simply for doing covers for this woman. I have actually had some work done by Lindsay. She restored two photographs for me of my grandmother and they are absolutely beautiful. She’s also taken photographs of my children and put them into fantasy settings. One of which hangs above my eldest child’s bed. It’s simply stunning. She is a very nice girl, open and honest, who cannot do enough to help others so to see her publicly ‘bashed’ is very upsetting. I have spoken to her in the last couple of hours and she is very sadden by this. So while I agree with exposing this Tabetha for her misdeeds, I really think the post should have been solely about her and her unethical business practices. Having said that, I do think Lindsay should cut all ties with this woman, they are nothing alike.

    On another note, this is a very informative blog and I look forward to seeing more post by you.

    There ought to be an RSS feed or something I know people do subscribe to it. However, I changed my format yesterday and am still fiddling with it.

    If Lindsay had come here without guns blazing, she would have received a far better response from people. She has a lot of talent, but not nearly enough craft. She would have gotten pointers and tips from professionals instead of derision. I also believe that she failed to think through the implications of her statements. My guess is that Tabetha got her riled up and she stopped thinking.

    I agree, I think Lindsay was very mislead by Tabetha and I’m genuinely worried. I understand her wanting to defend herself, especially since the post was originally about the publishing house. I think she was just upset at being slammed with no apparent reason. But I wouldn’t put it past Tabetha to have wound the poor girl up. I’m wondering if this Tabetha makes the bullets for other people to fire?

    Rusty, you said – I don’t mind Lindsay, and I don’t fault her for anything other than falling prey to Tabetha.- I am concerned about his myself and I am trying to keep my mouth closed. I don’t want to upset the girl, but I do think this woman may damage her. It would be a great shame.

    It’s Tabetha’s Modus operandi to get others – real or imagined – to defend her when she can’t stand her own ground.
    Lindsay means well. She’s just defending someone that doesn’t deserve it. I hope that one day she’ll take her talents solo and rid herself of that albatross and all the baggage that goes with it. She’s only hurting herself and her work by aligning herself with such a shady character.

Secondly obviously I am one fascinating bitch because none of you people can seem to keep my name out of your mouth. Bravo for me. I want to take the time to thank each and every one of you for making me the center of your world you have no idea how deeply flattered I am for this.     Since you seem to be sooooo interested this is the only version that anyone needs to worry with. It was rewritten the way it was supposed to be in the first place. Seeing that the former owners of the previous company I owned wouldnt allow me to do a rewrite and use the cover I wanted I finally got to do the way it was deem fit when I took over the company from her and her co owner(Mystic Press not Phoenix). This is the correct version and whether you like it or not I have quite a following on this series, so one bad review doesnt bother me. Some books arent meant for some people. To each their own.

    Oh and please let me know what questions I did not address and i will be happy to do so, and seriously if you didn’t want me all over your blog you shouldnt have written the trash you did about my company, my artist, and myself. You dont know me and anyone that wants true enough goes to the source not just pulls information from thin air. I will answer whatever you wish. But the things that happened with Mystic press were not soley my responsibility. There were previous owners that mislead me into taking over the company, but i am not the type of person that takes on something then gives up. I am not trying to place blame on anyone but simply tell you that there were problems on both ends. There were authors that used me, and being a new publisher yes I am sure i made mistakes, but regarding money, I have never held anyone’s royalties and kept them, I am not stupid. And as for their royalties they get 60% on print of what is disbursed to me from channels they are published on. So, if I get a disbursement for 500 bucks for example and it was for one title then they would get 60% for print titles sold and 50% for ebook titles sold. Its very simple. But again any questions you have for me ask them I have no problem answering them at all. And of course I am going to come out fists swinging, instead of being proper like a nice little girl. You bash me you get the bitch, you play nice I play nice, see how this works. I can be a very reasonable person, but when lies are being spilled from this one and that one do I not have the right to defend myself? Do I not have the right to explain what happened on my side of tracks? I have been nice enough not to name the names of the authors that took me, I have been nice enough not to go after them in court. But dont you think this is getting a bit out of hand. I mean how many blogs does this make about all this. Mystic Press closed down due to several reasons. Once the crap from the previous owners were settled and my name was cleared I talked with my attorney about opening another company. He warned me of the backlash. He warned i would be drug through the mud, but did he tell me to keep my mouth and shut and not defend myself, no he did not. So I apologize if I came off rude or touchy as someone stated but put yourself in my shoes. Everyone else can scream and rave about how they feel and how they got burned but what people dont realize is that I got burned too, so yeah I’m a bit on edge. I think I have a right to be after everything. But if you would like to ask questions and get the facts, go for it, I’ll answer anything you like.

    I have some questions, I am not directly involved with your company, but I have been following this discussion and others for a couple of weeks. If you wouldn’t mind answering the following, it would be appreciated. There aren’t many.

    1) Authors are telling bloggers you haven’t paid them their royalties, is this true? and if so, can they expect to receive them.
    2) Is it true your staff didn’t receive payment for services.
    3) Your artist was trashed on here last night. She came into a post that was attacking her and felt she had to defend herself. What is your take on this? Do you think this is fair?
    4) How exactly did you get burned? You shut the company down, you’ve started another….
    5) Do you realise that ‘bad publicity’ is NOT good for a publisher? How can it be free PR when people are telling others to avoid you? Bad publicity on a book is different. People want to read it to see if it really is that bad. People won’t come to your publishing house and say “oh lets see if I really do get taken for a ride.”
    6) I believe your fiancé has threatened several authors publicly on Facebook. Can you tell us why you would allow this? Do you believe this to be good business practice?
    7) Do you honestly believe you have done absolutely nothing wrong and that all this, everyone who is talking…. is lying?

    Think about what you’re saying. I have read some posts where the language that comes out of you is nothing short of atrocious. This really does you no favors Tabetha.

    My apologies, I did have one more question, and I believe this is the most important.

    You’re telling people how this all stems from the previous owners. I believe one of them is named Wendy. Without going back to the original post I cannot remember the other names. People are being told all this is their fault and that you are also a victim of theirs. While I understand you would have to deal with the backlash left by them, how is it there fault now? By that I mean, these problems that are being put forward are by authors who signed the dreaded dotted line with you AFTER these people (Wendy etc) were out of the picture. I believe you said you took over the company early this year, so how can what is happening now be their fault and not yours?

    I’m just curious….Having seen a Mystic contract already, where fees included in the contract’s initial set-up, book cover art is in this”pricing” along with other associated fees, why is it that the cover art wasn’t paid for?
    To my knowledge, quite a few former authors of Mystic did not care for the artwork for their books, and to boot the art work provided was chopping at best, and did NOT cover the expanse of the whole cover when printed copies came out of the press. Couple that with the fact a few authors had decided to seek alternate graphic artists and were labeled as “divas”. Why would that be a problem? If any author wasn’t happy with the Mystic approved Graphic Artist, (who mind you all wasn’t paid for services rendered, just FYI) why shouldn’t they find a reputable Graphic Artist with notable credits to their name and have it paid for?
    My understanding of the publishing world is the majority of publishers have a few Graphic Artists that they work with just for the simple fact that an author may have a specific design in mind that one or another artist is capable of doing.

    Along with that, when an author had signed their release form whereas they had to comply with the “NO Slander clause” Why is it that their name was spread around with just that, Slanderous intentions by Ms. Tabetha Jones? There is plenty of printed paperwork to back this up.

    How can so many authors who left Mystic be lying? And yet the one crying she’s “Victim of circumstance” be the only truthful one? I’d say there’s more to the former authors stories and this Ms. Jones just has a big mouth that chooses to cry VICTIM verses admitted to her lack of business knowledge…. No “Business woman” would stand up and shout as an ill-temptered child protesting her innocense with so many people standing up against her.

    Also, let’s not forget about claims that her business was being paid for using Federal Student Loans as well as fees paid for by authors seeking to get published. So either all these authors are lying, even with a culmination of electronically sent legal documents or Ms. jones has more explaining to do to the IRS and potentially the Justice Department. To my knowledge, using state and federal student funds meant to pay for school, and being used to fund a business is on I don’t know, a federal offense.

    I believe that when a “Publisher” hires a team to work for them, that they are obligated to keep tax records for services rendered as well as PAY their employees for their time and work. Sadly, I spoken to quite a few people who haven’t been paid to date….Hmmm, I do believe that some editors and Graphic Artists are being scammed along with these authors who decided to leave.

    Is anyone else noticing tread here? Or am I the only one, being a business owner who sees far too many flaws in this “publisher’s” business dealings?

    I truly feel for all the former authors, editors and graphic artists who have been scammed by Mystic Press and their associates and wish all of them the very best in their future endeavours.

    1.) If and when royalties are disbursed and if that particular author is due any they will receive payment. I don’t keep money that isnt mine.
    2.) Payments have been made.
    3.) No I dont think trashing my artist was an adult thing to do. She is highly talented and deserves the best, not to be slatted on here. She has been with me since the beginning and although others had negative things to say about her work, I believe her to be highly talented and they should have NOT attacked her in any way.
    4.) I pay for certain things out of my own pocket, pr, editing, swag, etc. When you have authors that take advantage of those things including several copies of paperbacks you have ordered for their release, and the cost of editing, pr, and swag, and then back out then it takes a toll on you and you get burned. I had several authors do this to me. Did any of them pay to be released from contract after they took advantage, no. They got what they wanted and went on there way.
    5.) At this point I really could careless because I know what happened. Whether its good bad or ugly, its pr. And it hasnt stopped anyone yet. I actually signed a new author a week or so ago. They know everything that has happened.
    6.) My fiance never threatened anyone, he stated that if people had questions they needed to direct it to private messages or email. The statement in question about heads are going to roll was not made to anyone specific, he said it because he was tired of the backstabbing and this author saying this and then copying and pasting what this author said, or this editor said. This bandwagon of haters have no idea how much crap they have actually said about one another. I wonder if they would all be such good buddies if i broad casted it for the world to see?
    7.) I am not saying I did nothing wrong per say I may have handled the situation wrong, but I shut the company down as best as I could, with a formal letter sent via email. I went by my lawyers instruction and did what I could. There was no easy way. And this somewhat ties into your last question. If I had not had to face the problems at hand due to the previous owners, then maybe I could have found ways of saving Mystic but even then I think that shutting it down was the best thing to do. I had no knowledge of what the previous owners were doing until months after the fact of me owning it. Then it just keep going one thing after another. Mystic was tainted because of what they had done. Then on top of everything my own peers scammed me, burned me, and that takes its toll. So i did what I had to do and shut the company down because the last month of owning the company there was so much backstabbing between authors and staff that it was the only logical thing to do.

    What gets me that this story has somewhat mutated from the original, bloggers have twisted words, mad authors have lied, and it is so far from what really happened that i dont even know by answering these questions if it will honestly help anything. Everything has been twisted and turned so whoever is writing it makes it seem fitting and honest. Now, I plan on continuing in the publishing world, with my work and works of others. I have several that have followed from the old company and we already have several releases out. But this is getting old and I hope by answering the questions this can finally be put to rest and left alone.

    But…
    Tabetha’s contract says that all royalties will be paid immediately upon termination of the contract. And, unless I’m mistaken, every contract under Mystic Press was terminated when it closed.
    Yet there are many authors that haven’t yet been paid. They’re being told that they’ll get paid when she, Tabetha, receives book sales information and money from Amazon. What part of that is immediate?

    For the record, anybody that’s got a title on Amazon, author or publisher, has instant access to sales and royalty information. There’s nothing to wait for. Tabetha knows exactly how many books have sold, how much they’ve earned, and therefore how much she owes each and every author. Yet they remain unpaid.

    As for having to wait for Amazon to pay before the authors can get paid (which is in no way immediate) Amazon pays every month for the previous month provided it earns the $10 minimum. It’s been at least that. So much for that immediate thing.
    My favorite part of Tabetha’s replies is her assertion that she’s been nice enough not to take the authors who’ve scammed her to court. I wish she would. I’d LOVE to see the explanations she comes up with to substantiate her claims to a judge. Her victims, on the other hand, would probably have quite a lot to say.

    She says that she pays for certain things out of her own pocket. There are two things wrong with that. First, no she doesn’t. She pays for things out of her authors’ pockets, and many of them have received absolutely nothing but insults for their investment.
    Secondly, it’s the height of bad business to mix private money with company money. If she doesn’t know any better than that, perhaps she should get out of business before she gets herself into any more trouble than she’s already in and seek an honest living. The fascinating world of fast food, perhaps. From the language and content of her insults and replies, that seems about her mental speed.

    One question that I still haven’t seen an answer to is why there are still books listed for sale on Amazon.com that have Mystic Press as their publisher and, I believe, the same ISBN numbers. Did Mystic Press close down or didn’t it? People are being told that another reason they haven’t been paid is that it’s taking time to change the name on the accounts from Mystic Press to Phoenix Fire publishing. Somebody that knows more than I do can clarify, but don’t all accounts and products cease to exist when a company closes down? So which is it? Did the company really close down, or is Tabetha simply changing the name to try and weasel out of her responsibilities to the authors that signed to Mystic Press?

    Apparently, she “really could careless” because she keeps coming back to try to prove what a poor, innocent little victim she is. I don’t know who she thinks she’s convincing, but it’s amusing to watch every time she tries.

    I see, well thank you for answering the questions. Whether people choose to believe the answers is up to them.
    I notice Sara said your artist has been slammed before, and people wanted another artist to look at their work. Is this why you hired Lindsay? Did you hire her to take the crap away and replace it with real art? I believe the company originally worked with somebody called “must love fangs”. I’ve seen some of the work and it is truly awful. No wonder people wanted to move to the other artist. Also, it wouldn’t surprise me if this is why some of the authors decided to leave your company. Looking at the work I can see Lindsay has only been doing the covers for the last few months. I confirmed this by looking back on her personal blog. She isn’t responsible for the rubbish you allowed to go with your authors books. So your comment of – “She has been with me since the beginning”- Is clearly another lie.

    I completely agree. I hope none of those people are tainted by what has happened here. I also believe some of the staff you have at present will soon leave you.     What we have here is an excellent example of triangulation. All the signals are crossing to reveal the location of the truth. Tabetha has hurt a large number of people. There is nothing innocent about Tabetha’s business practices. Lindsay was the only REAL person who tried to defend Tabetha. The others are alts of hers.

When someone else does come on to tell their story, the ones who are happy I mean, they get attacked, abused and accused of being fake. Maybe they simply don’t see what good it will do.

    I treat people how I myself expect to be treated, and I speak openly. Sometimes that isn’t welcomed, but what the hell. My main concern here is for the young graphic artist, I’ve read the posts and as far as I am concerned, she didn’t come in guns blazing, she was just clearly upset, shocked and distressed. I think she was treated badly.
    I did say before that I had worked with her, she’d restored photographs and worked on photos of my children. I’m hoping to have more photographs restored by her in the coming months. I spoke with her earlier, and she was so upset and sad. I think she was brought into this whole thing unfairly.
    Other than that, and the slut comment, I cannot fault this blog. I’ve finally learned how to follow you and I’d like to keep popping by when I can.

    Does Ms Jones really have an attorney? I realize she has mentioned she has one on numerous occasions, but has any of the former authors or employees ever spoken to this “Lawyer”?
    I’m sure as a professional “BUSINESS WOMAN” Ms. Jones wouldn’t mind informing the public of her attorney’s name, given the fact it would be public knowledge.
    Although claiming you have an attorney and actually having one at your disposal are two entirely different things.
    Anyone can claim they have a lawyer at their beck and call. Yet when a person cries poverty, how are they capable of affording a private attorney for all their legal needs with as many unsatified clients as Ms. Jones and Mystic Press/Phoenix Fire has and will continue to have?

    I will say though, that when a person claims loyalty to their clients and discretion only to turn around and complain to other clients about any one particular author is most unprofessonial if you ask me. As well as throwing your staff under the bus to save your own reputation that clearly has been tainted as we have all witnessed.

    Tabetha please just admit that you are not the “Business woman” you claim to be, that you’ve scammed and hurt more people than a small plague with your lies and this continual need to try and prove a lie is overspent.

    You’ve caused much damaged to people with honest and actual talent. You’ve spent money that didn’t belong to you, paid to your business from hard working authors trying to make a name for themselves. You’ve cheated them and lied. You’ve cheated your staff out of money which you have shown no proof having paid a single soul.

    Assuming this attorney is a) real and b) minimally competent, he or she will be fully aware that the Supreme Court has already ruled that blogs are, by definition, opinion, and are therefore not actionable under the laws governing libel. Failure to advise his or hr client of the futility of pursuing any suit because of anything said here would likely result in disbarment, and rightfully so. Bar associations tend to discourage incompetence as a salient characteristic for their members.

The link to Lindsay’s blog is a link to her interview with Tabetha. The interview is part of general research. Reassure Lindsay that nothing more will be said about her here unless she requests it or asks for advice.

    as “Author”)concerning a work presently known as

    The Contract is considered legal and binding in all countries. If there
    should be any legal dispute, the laws of the state of Texas shall apply.

    I. The Author hereby represents and warrants to the Publisher that:

    A. The Work is free and clear of any counts of libel, plagiarism, breach
    of privacy or misrepresentation of facts.

    B. The Work does not infringe upon any copyright or proprietary right,
    common law or statutory law, and does not contain any material of
    libelous nature.

    C. The Work is not in the public domain and the Author is the sole owner
    and copyright holder of the work with full power to enter into this

    D. If the Work has been previously published in whole or part, the Author
    currently holds all copyrights to the Work and is legally permitted to

    E. The Author releases Publisher from any responsibilities relating to
    any legal actions incurred by the contents of the Work or the Author.

    F. The Publisher will obtain appropriate ISBNs for the Work under the
    name of Mystic Press.

    A. The Author, on behalf of himself/herself and his/her heirs, executors,
    administrators, successors and assignees, agrees to grant the Publisher
    exclusive rights to produce, publish and sell the work in electronic
    format (including email, download, disk, CD, or any other digital format
    known or to be invented) the work.

    B. The author may request their book be put into POD (Print on Demand)
    at the author’s expense. Author agrees to pay printing costs to the
    publisher prior to the publisher submitting the work to print.

    I. $87.50 (USD) for Lightning Source (per title)

    II. $35.00 (USD) Createsapce + 1 proof copy (includes shipping) per title

    III. $20.00 (USD) Cover Art per title (unless author has own)

    C. If added to a returnable catalogue, the author accepts full
    responsibility to “buy back” any books returned by stores and or
    distributors hereby relieving the publisher of any financial
    responsibility.(Amendment: If author is unable to “buy back” then
    publisher agrees to help the author get the books back.)

    D. The publisher will provide the author with professional, “Mystic Press
    Approved” editors. Editing is included and will consent of three rounds,
    unless publisher deems editing not necessary.

    E. The author agrees to cooperate with the editor and design team, and
    also agrees to meet deadlines set by the publisher. (Amendment: There
    does not have to be no certain deadline set. That will be discussed

    between the author and the publisher for release date.)

    A. All rights will be exclusive for 2 years commencing on the date these
    books are released. After such time, the contract can continue if both
    parties agree.

    Contract may be terminated after 1 year by either the author or the
    publisher with a 90-day written, certified mail notice or other receipted
    delivery service, and all rights granted the publisher will revert to
    author.

    Upon breach of contract, the Contract may be terminated by either party
    with a 30-day written notice. Notification of breach and intention to
    terminate the contract is to be delivered by certified mail, e-mail or
    other receipted delivery service. If breaching party corrects breach
    within 30 days, the contract shall continue to remain in place until its
    natural expiration. Upon expiration of the contract term, all rights
    granted the Publisher will revert back to author when the disclaimer is
    signed and returned.

    B. During the term of the contract, the Work will not be said to be out
    of print.

    C. Author may terminate the contract at any time, with 30 day notice. The
    cost for early contract termination is $350.00 (USD) to be paid at the
    time notice is given. This is for the publisher’s time and efforts, book
    cover work, book trailer etc.

    A. Author shall provide an acceptable, final revision of the manuscript
    in either Microsoft Word or RTF within the time agreed upon or this
    contract will be void. Publisher will not be held liable for lost
    manuscripts. Author should always keep a backup copy.

    A. Publisher and Author will mutually set the retail price of the Work
    based on length and comparable works. A. Publisher and Author will
    mutually set the retail price of the Work based on length and comparable
    works. Publisher agrees to pay to the Author, a royalty of 50% of the
    retail E Book price. If the Work is purchased in print, the royalty will
    be 60%.

    B. The Publisher has the right to contract with distributors, bookstores,
    vendors, organizations and or outlets of printed and electronic books to
    sell the Work in association with the Publisher’s name. For all sales
    through these outlets, the Author will be compensated 30% of the download
    and/or sale price less any handling costs or discounts charged by the
    outlet.

    C. In order to stimulate sales, the Publisher reserves the right to lower
    the price of the Work after a reasonable amount of time if the price
    appears to be too high (no sooner than three months).

    D. Royalties shall be calculated and paid no later than forty-five (45)
    days following the end of each calendar quarter for sales during that
    quarter. Royalties shall be paid by check, unless previous arrangements
    are made with the author. Payment arrangements, mutually agreed upon by
    the Publisher and the Author, shall be made for payment of royalties to
    Author if he/she resides outside the USA. Royalties equaling less than
    $20 will be held until such a time as they accrue to $20 or above. Any
    withheld royalties shall be made immediately upon contract termination.

    E. No royalty shall be paid on paper or digital copies distributed for
    review, advertising, publicity, promotional purpose, samples, or other
    similar purposes, or on copies sold below or at cost.

    E. If Author has elected to grant Publisher the right to contract
    with various distributors and outlets, royalties will be paid to
    Author contingent on payment received from distributor. In most cases,
    distributors pay Publishers every sixty to ninety days for sales through
    their channels during those timeframes.

    F. The Author is responsible for paying his/her own taxes on all royalty
    payments received from Publisher and is advised to keep accurate
    records for tax purposes. A 1099misc form will be sent to the author if
    necessary.

    A. The Author shall provide the Publisher with biographical information,
    a photo, and a suggested blurb for use on Publisher’s website. Author
    agrees to give Publisher the right to use the Author’s name, likeness,
    title of work and biographical material for publishing, advertising and
    promoting the Work. Publisher reserves the right to edit or rewrite the
    blurb submitted by Author.

    B. Cover art will be provided by Publisher. If the Author has his/her own
    cover art, the Author must warrant that the provided art is either owned
    by the Author or that it does not infringe on any copyright.

    C. Publisher reserves final approval of art in consultation with Author.

    D. Author agrees to self-promote the Work to the best of his/her
    ability. If Author has his/her own website, the Work must be linked
    to the Publisher’s website. With any promotional material the Author
    generates, the Author will consult with Publisher to insure proper use of
    Publisher’s name and/or other information.

    E. Author may use the first 10 pages of the work to post on his/her
    website blog or Facebook) or to give away as “teasers” to promote the
    work provided it includes a link to Mystic Press Publishing.

    F. Publisher will send out the work for review to no less than three
    review sites. Author may request a review copy in e-book format. Author
    is encouraged to solicit reviews along with the Publisher. For added
    promotional purposes, Publisher and Author agree to notify each other as
    to what review sites submissions have been made.

    G. With enough advance notice, Publisher will provide Author any needed
    book copies for Author appearances or signings. These copies would be in
    the format of print and can be purchased by the author at a discount set
    by the Publisher.

    H. The publisher agrees to provide the author with marketing and public
    relation work through Zaphyre Marketing and Public Relations to the best
    of their abilities.

    I. Author is required to maintain a website/blog at all times (Facebook
    page for the author of book is acceptable).

    A.”Mystic Press” may at any time sell itself, or the majority of itself,
    its holdings, or licenses. Current contracts would transfer to the new
    owner.

    B. Bankruptcy: If “Mystic Press” is legally judged bankrupt or liquidates
    its business, this Contract shall be terminated effectively and all
    rights granted to “Mystic Press” shall be terminated.

    This Contract hereby constitutes the entire agreement between Author, Co-
    Author, and Publisher and supersedes all previous agreements regarding
    the Work, whether oral or in writing. Modification of this contract may
    only occur in writing, signed by both parties.

    I haven’t seen Lindsay defend Tabetha for a while now. I believe she came here to defend herself. And I’m sorry, I don’t think its fair for a freelance artist and just a friend to be dragged through the mud. While I understand what you are saying where the friendship is concerned, her business practices do not affect how they are with one another.

    Tabetha is a liar and a cheat, but their are legitimate authors out there who defend Tabetha and who have stayed loyal to here throughout the old company closing and the new company opening. Maybe they have had a different experience. I don’t know. Personally I wouldn’t trust her as far as I could throw her. But that’s me.

    I don’t believe this to be true. You’re basically saying Lindsay is a scam artist and yet only yesterday you were saying you had no problem with the young girl. I also find it hard for them to ‘hang out’ since Tabetha is in Texas and Lindsay is in the UK.

    As for the authors who stay with her, you have no right to say anything about them. They are happy where they are, they must be getting what they want. Although, I do believe in time they will also be scammed. But again, if they are happy and getting the service they want, why should they be tainted?

I have no clue who you are but there have been many that have been hurt by this person and yeah they have the attitude because they have been told over and over again that they are Crybabies and to build a bridge and get over it. I am not sure about anyone else, that is much easier said than done. I do not know how many blogs you have read.
    If you hang out with the wrong crowd, then you are deemed bad most of the time. More or less, guilt by association. I am not downing anyone, just stating the obvious.

    Guilt by association does not apply to freelancers who avoid getting entangled in their client’s troubles. Key word: avoid. I sent out letters to my freelancers and employees warning them to stay out of these threads and to keep their heads down. they can read, but they can’t post. If Tabetha was any kind of responsible person, she would never have enlisted Lindsay to defend her.

    Hi Amanda – I have not been scammed by Tabetha, I know a couple of people who have and I have worked with Lindsay on some personal projects. I’m an avid reader, but I am not an author, However, I respect anyone who is able to write a book. That is a talent. I knew of Mystic Press through a couple of authors who were upset when Mystic closed. One of whom was trying to have money refunded to her for books she had not received. I’ve followed this ever since. I’m not a very tech friendly person, and so I had to be shown how to comment on the blogs, how to sign in etc. Hence the reason this is the first blog where I have been able to join in the conversation.

    Again, I don’t see Lindsay defending Tabetha on this particular blog, she was only defending herself. I know she wrote some comments on other blogs, but that has come to an end. I think the girl has seen sense. She does the covers but has no other involvement in anything. She was deeply distressed and worried by this.

    I know people DO get tainted by association, (that isn’t putting words into anyone’s mouth before Lepplady decides to say anything, its a figure of speech.) I just think its wrong personally. That’s just simply my opinion.

    This I agree with on the other blogs, but again on this one I can only see Lindsay as upset and defending herself. Not Tabetha. With a bit of luck, she won’t defend her again either. But who knows. I did email her earlier today asking if she would perhaps allow us to see a copy of the new Phoenix contract. It is Christmas day, so as yet I haven’t received a reply. I’ll let you all know as soon as I do.

    Speaking of Christmas, I hope everyone one of you, and yes Lepplady, that includes you. We may not agree and clash but I still value your opinions and thoughts, has had an absolutely wonderful day, and that that continues on throughout the rest of the Christmas and New Year period.

    Look, I really don’t have a problem with Lindsay. She and I have always been able to talk frankly and honestly. That’s why I feel like I can say, in all honesty, that she’s not doing herself any favors hanging around with the likes of Tabetha and her boyfriend. And none of them are doing themselves any favors jumping on blogs under different names to try and make themselves look better. People aren’t stupid. If any of those three have something to say, they need to just come out and say it as themselves. If they speak honestly and with credibility, they won’t get attacked. It’s the bullsh*t that people are reacting negatively to.
    Out of the three, I hold out the most hope for Lindsay, despite her allegiances. I’ll never understand why she would ignore (and therefore condone) the actions of someone like Tabetha, but that’s her business. Getting lied to is my business. And it’s the business of every other person that’s been burned. I’ve said it before and I’ll probably say it again after this: If Tabetha wants people to shut up and go away, she needs to pay what she owes, to all of us.
    I only hope Lindsay wises up and doesn’t follow any further in her friend’s footsteps. She’ll get back her credibility, which she’s allowed Tabetha to completely strip away from her. She’ll have better business, and she just might make some friends that don’t lie to people’s faces. If that’s what she wants, that is. If she chooses instead to stay with the likes of those two, she’s got to be prepared to be treated like them. It’s her choice.

    I wouldn’t say she condones it at all. I believe she is stuck in the middle of a lot of different stories and just doing her own thing. She does the covers, that’s all. I know enough of Lindsay to know full well she would not use a false name. She would only ever speak as herself. She isn’t a liar. Also, I don’t think she has lost her credibility, or lost any business for that matter. We all know her to be open and honest and very straight forward. She has a hell of a lot of friends, it just a shame that Tabetha happens to be one of them.

    Martha, where are you from and how old are you that you would choose to refer to Lindsay as the “young artist” as if she were a fragile child? She’s an adult. That criticism on this thread was very very mild.

    I’m beginning to wonder if you, martha, are actually Lindsay herself. You see, Lindsay’s IP traced back to NASA.gov. She was using a proxy. Now, why would Lindsay use a proxy?

Also like I said there, I have no idea what a Proxy is, I am with Sky, I have the TV, Internet and phone package and I do not know how I can be connected to NASA when I live in the UK.

    Lepplady, the reason I didn’t say was for two reasons, one being the fact that I would have instantly been seen as bias and two, nobody would have paid attention to the fact that I do not like this Tabetha, I would have been seen as a fake, (I suppose that doesn’t matter as it seems now I am anyway.) trying to defend someone associated with her. Also, I did not want this woman running to my niece and attacking her because her aunty dared speak out against her on a public blog. These are my thoughts and opinions, not Lindsay’s, but I think she has has enough upset with causing more between her and Tabetha.

    Now that the cat is out of the bag I will say this. Lindsay and I are currently at logger heads. She understands my worries where Tabetha is concerned, but she assures me she is not getting involved any more. She is simply doing the covers and hosting some authors on her blog. I have told her she is not to comment, or even read these blogs any more.

    My niece was at my home when this was first noticed. We wouldnt’ be able to see each other over Chrismas and her and her sister came around to swap gifts. She was broken hearted and I consoled her and told her not to retaliate. Sadly she didn’t listen, she was too upset and her mouth ran away with itself. I was however proud to see that she only defended herself and not the witch.

    We have had a blazing argument over the telephone this afternoon as she has found out my son educated my on how to comment on blogs. She knows I have been on here and another site and refuses to come on and read what I have wrote. She doesn’t want me to fight any battles for her as in her words “she isn’t at war with anyone, she just wants to be left alone”. But what am I supposed to do when I know how upset she was and she is my family.

    It’s internet speak for “owned.” I do wish you had come clean from the beginning. It’s clear there is a lot about the internet that you don’t understand. I’m 58. I have a 30 year old daughter. Well, 30 going on 13 at times. LOL. These conversations with you could have been so much better if you had. There’s nothing wrong in defending your niece. I have defended my daughter on many occasions over the years. Our bouncy hyper troll is my daughter. Steven Beeho, one of my authors and editors (my flaw-finder general as I like to call him fondly) got hold of me and said, “Sovay’s posting.” He had recognized her style. She had used a proxy and an address I did not know.

    I can assure you I do exist. And I admit, where the internet is concerned, in fact where computers in general are concerned, I am far from educated. I guess you’re never too old to learn though and I do find it interesting.

    I am sorry I didn’t come clean from the start. My main concern was for Lindsay. I didn’t want Tabetha to jump down her throat because of my speaking out. Now that the truth is out there, we shall see what happens. As you may have noticed Lindsay isn’t afraid to run her mouth off. She just opens it before thinking properly. If Tabetha attacks her, Lindsay will wipe the floor with her. It will cause nothing short of a public and explosive argument and that is something I didn’t want to risk.

    Don’t get me wrong, I’m very proud of my niece. She is a fantastic girl with a heart of gold. She’s a published writer, artist, and I love her to pieces. I often told her mother she should have been mine, but she won’t part with her lol. Like I said earlier, I just wanted to avoid any upset I may cause by commenting.
