Message from Rusty Nail


Guest Statement from Rusty Nail:

Nicky reported me to WP for an entry that contained screenshots.  WP alerted me to this, and frankly, they’re not sure whether it’s a TOS violation.  Copyrighting screenshots?  They’ve never before heard of such a thing.  In the meantime, I have two new blog entries pending review by the WP folks.
Although I’ve heard back from the guy, confirming who it was who reported me, as if there were ever any doubt, the issue remains unresolved, and I cannot post to my blog, other than to queue things for content review by the powers that be at WP.  All I can do is comment on previous entries, until this gets resolved, and my posting privileges are restored.

No doubt, the Nickster will crow about his victory, but I can assure everyone that it will very short-lived, and I shall prevail.

    My guess is they’ll need to make a decision as to whether or not they qualify as violations, since it doesn’t sound like they have a policy regarding screen shots. When they come to that decision, they’re likely to A) drop the complaint and let Rusty get back to business or B) Ask her to remove the screenshots and let Rusty get back to business.

    I don’t care if WP does remove the entry about which Nappy complained. Autoaim’s going to grab screen shots of everything Nicky ever posted at AC and post them on his site. Until they are done with their review process, however, I can’t even delete the damn entry myself.

    Seriously, though, they really shouldn’t be holding new text entries while they make a decision about whether screenshots violate copyrights.

    I think part of the reason for the lockdown is so they can look into the matter without interference.

    My guess is that all the accounts and their posts are organized into some kind of database, and a blog can stand out as a database in its own right. With the amount of transactions that can go on in a day, it’s difficult to fix something if the file is constantly changing.

    Granted this may not be the most accurate assessment of the situation, but at least it offers a different POV.

    That sucks, but I can see they’d need to go running to their lawyers since they’ve been formally prodded. Otherwise they’d risk losing their (nebulous) rights in the matter. And given that, a lockdown on the journal makes sense, so nothing’s changing while it’s being reviewed.

    I’m with Mike on this.

    Still, lame.

    Here’s a thought:

    Nicky’s gripe is about a screenshot? Twenty bucks says it’s the one that catches him doing a Yahoo search for his sleepsack.

    Odd to us, perhaps, but I know I’d be slightly embarrased if I had something kinky in a search string held up to the public eye in a screenshot. (My tongue-in-cheek fantasies of Anne Hathaway wrapped up notwithstanding)

    Now, we know Nicky can’t take negative input well, so imagine how he handles embarrassment…

    I was going to write today, but instead I figured I’d be an obnoxious jackass.

    I’ve statted up Nick Kane twice, just to be a dick. Once for d20 Future, once for d20 Modern, a friend is doing it for Call of Cthullu, and I’m doing it for the Palladium System right now.

    Why?

    Well, believe it or not, those are genre specific, and are actually considered equal of novels. I learned a lot when I got C&D’d awhile back by Nintendo. That’s when I learned what genres cross, what ones don’t, and how a “character” or “IP” worked in the gaming world.

    Technically, if I wanted to be a dick, I could even do d20 creations of his shitty stories, and there wouldn’t be shit he could do about it, as long as I kept the IDEA and didn’t use the content.

    But, that’s too much effort.

    Instead, I’ve just created several Nick Kane’s.

    Why not? I created him in 1985, why shouldn’t I use him?

    It’s only too bad that being a thin skinned little whiner like Nicky is, and flying off the handle whenever someone disrupts his fantasy world by posting something truthful about him and how his life really sucks isn’t a TOSable offense.

    If that was the case, we would’ve seen the end of Nicky years ago.

    Hopefully Rusty gets those issues resolved so we can get back to business.

    It’s all cool with WordPress, now. I should have out of commission for about half an hour. The truth of the matteris, when I contacted the guy again, he admitted that he should have re-enabled my posting when he originally contacted me, but for got to do it.

    The Rusty Nail is back in commission. As if there was ever any doubt that it would be . . .
